AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you (“you”) and Blend Salon WI (“we,” “us,” or “our”), concerning your access to and use of the www.blendsalonwi.com website and any related services, including appointment booking and product purchases . By accessing or using the Site, you agree to be bound by these Terms . If you do not agree, you must discontinue use immediately .

We reserve the right to change these Terms at any time. The updated “Last Updated” date will indicate changes, and your continued use constitutes acceptance of the new terms .

1. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the Site, its content (text, graphics, logos, images), and our trademarks are our proprietary property and are protected by intellectual property laws . You are granted a limited license to access the Site for personal, non-commercial use only . You may not copy, reproduce, or exploit any content without our express written permission .

2. USER REPRESENTATIONS

By using the Site, you represent that you are at least 18 years old , have the legal capacity to agree to these Terms, and will not use the Site for any illegal or unauthorized purpose .

3. APPOINTMENT BOOKING, PAYMENT, & SALON POLICIES

· Bookings and Payments: When you book an appointment or purchase a product, you agree to provide accurate information. We accept payment methods as listed at checkout . All prices are subject to change .

· Cancellation & Late Policy: We respectfully require at least 24 hours notice for appointment cancellations or changes. Cancellations with less than 24 hours notice may be subject to a charge of 50% of the service fee. No-shows may be charged 100% of the service fee . Late arrivals of 15 minutes or more may result in rescheduling to best accommodate other guests .

· Service Satisfaction & Redos: Due to the artistic and custom nature of our services, we do not offer refunds on services performed . However, we stand firmly behind our work. If you are not satisfied with a service, please contact us immediately within one week of your appointment so we can remedy the situation .

· Product Returns: We stand behind our retail products. Unused products in original packaging may be returned within 30 days of purchase for an exchange or store credit . For hygiene and safety, all sales on certain items (e.g., hair brushes, accessories) are final .

4. SMS/MMS MESSAGING PROGRAM TERMS

By providing your mobile phone number to Blend Salon WI, you voluntarily opt-in to receive recurring automated SMS/MMS text messages from us. Message frequency varies. This program is used for operational communication and, with your additional consent, marketing purposes.

4.1 Types of Messages & Use Cases

You may receive messages related to:

· Appointment Management: Confirmations, reminders (including multi-message sequences to reduce no-shows), rescheduling options, and last-minute availability alerts.

· Operational Alerts: Notifications about salon hours, closures, or important updates.

· Service Follow-Up: Requests for feedback or reviews after your appointment.

· Marketing & Promotions (with consent): Information about new services, stylists, exclusive discounts, flash sales, seasonal specials, referral programs, and product launches (e.g., our Femme Fatale bodycare collection).

· Client Re-engagement: Automated reminders for recommended rebooking based on your past services.

4.2 User Opt-In & Consent

You may opt-in verbally, via a paper form, or by submitting an online form. For promotional messages, we use a double opt-in process where you must expressly agree to receive such messages. You represent that any mobile number you provide is yours and you are authorized to consent to receive messages at that number.

4.3 User Opt-Out & Support

You can opt-out of all SMS messages at any time. To unsubscribe, text STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to the number from which you received our messages. We will then send a one-time confirmation of your opt-out. For assistance, text HELP or contact us directly at the phone number or email listed in Section 11.

4.4 Message & Data Rate Disclosure

Message and data rates may apply. You are solely responsible for any message or data fees charged by your mobile carrier. Charges depend on your specific mobile plan and may apply to sending, receiving, or interacting with our messages, including multimedia (MMS) messages. We do not charge for this service, but your carrier's standard rates apply.

4.5 Carrier Disclaimer & Program Limitations

The SMS/MMS service is offered on an "as-is" basis. We are not liable for any delays, misdirected messages, or delivery failures. Message delivery is not guaranteed and depends on your mobile carrier's network. We do not guarantee the service will be available in all areas or on all carriers. Carriers are not liable for delayed or undelivered messages.

4.6 Privacy

Your privacy is important. We will not share your mobile number with third parties for marketing purposes. Our use of your information is also governed by our Privacy Policy.

5. PROHIBITED ACTIVITIES

You agree not to use the Site to harass our staff, engage in fraud, misuse the booking system, interfere with the Site’s security, or violate any laws .

6. USER GENERATED CONTRIBUTIONS

If the Site allows reviews, comments, or photo submissions, you are responsible for your contributions. By posting, you confirm you have the rights to the content and that it is not unlawful, abusive, or misleading . We reserve the right to monitor and remove any contributions .

7. THIRD-PARTY WEBSITES & CONTENT

The Site may contain links to third-party websites (e.g., social media). We are not responsible for the content or practices of these external sites .

8. SITE MANAGEMENT

We reserve the right to monitor the Site, refuse service, terminate accounts, or cancel appointments at our discretion .

9. PRIVACY POLICY

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information. Please review it .

10. LIMITATION OF LIABILITY AND INDEMNIFICATION

To the fullest extent permitted by law, we are not liable for any indirect or consequential damages arising from your use of the Site, our services, or products . You agree to indemnify us from any claims resulting from your violation of these Terms .

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Wisconsin. Any disputes shall be resolved in the courts located within Fond du Lac County, WI.
